1. Who we are and what these terms cover
FOGProof is a software platform for grease trap service recordkeeping — QR-coded trap logbooks, mobile service logs, reminders, exports, and inspection packets — available at getfogproof.com, app.getfogproof.com, and related pages (together, the Service). The Service is operated by Quantic Studios LLC ("FOGProof," "we," "us"). By creating an account, accessing the Service, or clicking to accept these terms, you agree to them on behalf of the business you represent.
2. Business use only
The Service is offered to businesses — grease haulers, liquid waste service companies, restaurants, and restaurant groups — not to consumers. You represent that you are at least 18 years old, that you are using the Service for business purposes, and that you have authority to bind the organization you sign up for (your Organization). "You" in these terms means that Organization.
3. Accounts and access
- Sign-in uses one-time email codes; there are no passwords. You are responsible for keeping access to your team's email accounts secure.
- Organization owners and admins control who can join the Organization, each member's role, and what they can see and do. You are responsible for the people you invite.
- Notify us promptly at [email protected] if you believe an account has been accessed without authorization.
4. Free trial
New Organizations receive a 14-day free trial. No payment card is required to start. If you do nothing, the trial simply ends: paid features stop working, no charge is made, and nothing is owed. Your records are not deleted when a trial lapses — see Section 9 on data export and deletion.
5. Subscriptions, billing, and plan limits
- Paid plans (currently Starter, Pro, Growth, and Enterprise) are billed monthly in advance through Stripe, our payment processor. We never see or store your full card number.
- Each plan includes stated limits (for example, the number of active locations) and features. We enforce those limits in the product.
- Subscriptions renew automatically each month until cancelled. You can cancel at any time from Settings → Billing; see our Refund & Cancellation Policy for exactly what happens when you do.
- We will give at least 30 days' notice by email before a price change affects your renewal. Prices exclude any applicable taxes, which you are responsible for.
- If a renewal payment fails, we will retry and email you. Access may be suspended if payment continues to fail after a grace period.
6. Your content and ownership
Everything your Organization puts into the Service — client and location records, trap details, service events and readings, photos, manifests, notes, and signatures (Customer Content) — belongs to you. We claim no ownership of it. You grant us a limited license to host, process, back up, and display Customer Content solely to provide and support the Service. Export is built in: PDF packets on every plan, and CSV export on Pro and above. No lock-in is a product promise, and this section is its legal backing.
7. Public QR pages and the people in your records
Each trap can have a public QR status page. These pages are deliberately minimal — status, last service, next due, and your contact details — while full history and files stay behind authorized access. Because Customer Content includes information about your own clients, managers, and technicians (names, signatures, photos), you are responsible for having the right to record that information and for what you choose to expose on public pages. We process it on your behalf as described in our Privacy Policy.
8. Acceptable use
You agree not to:
- create false, backdated, or misleading service records, or use the Service to misrepresent work that was not performed — the product exists to prove real work;
- break the law, or infringe anyone's rights, in your use of the Service;
- probe, breach, or test the security of the Service, access another organization's data, or exceed rate limits by artificial means;
- reverse engineer, scrape, resell, or white-label the Service except as the product's own branding features intend;
- upload malware or content you have no right to store.
We may suspend or terminate accounts that violate this section.
9. Data export, retention, and deletion
- You can export your records from the product at any time while your account is active.
- If your subscription ends or your trial lapses, we retain your Organization's data so you can come back or request a copy. Email [email protected] and we will provide a complete export of your Organization's data.
- You can request deletion of your Organization and its data at any time; we will honor verified requests within 30 days, except for minimal records we must keep (for example, invoices and security logs).
- We may delete data belonging to long-inactive, unpaid Organizations after giving at least 30 days' notice to the Organization's email addresses on file.
10. Recordkeeping disclaimer — please read this one
FOGProof is an operational recordkeeping tool. It is not legal advice, a compliance service, or a guarantee of any regulatory outcome. FOG and solids percentages are operational measurements. Local grease trap and FOG program requirements vary by jurisdiction, and inspectors and municipalities set their own rules for what records they accept and how they must be submitted. You remain solely responsible for your compliance with the laws, permits, and programs that apply to you. We make no promise that any inspection will be passed or that any authority will accept records produced by the Service.
11. Availability and support
We work to keep the Service available and fast, and we monitor it, but we do not promise uninterrupted or error-free operation and these terms do not include a formal uptime SLA. We may perform maintenance, and we may change or retire features with reasonable notice when the change is material. Support is provided by real humans at [email protected] and through the in-app support inbox, on every plan.
12. Our intellectual property
The Service — its software, design, and the FOGProof name and branding — is ours and remains ours. If you send us feedback or suggestions, you agree we may use them without obligation to you.
13. Third-party services
The Service depends on third-party providers (hosting, file storage, payments, email delivery) listed in our Privacy Policy. Payments are subject to Stripe's own terms when you enter card details on Stripe-hosted pages.
14. Warranty disclaimer
The Service is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
15. Limitation of liability
To the maximum extent permitted by law: (a) neither party is liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data; and (b) our total aggregate liability arising out of or relating to the Service is limited to the amounts you paid us in the 12 months before the event giving rise to the claim (or US $100 if you have paid nothing). These limits do not apply to your payment obligations or to either party's willful misconduct.
16. Indemnification
You will defend and indemnify us against third-party claims arising from your Customer Content, your violation of these terms, or your violation of law — including claims by your clients, employees, or technicians about information you chose to record or publish through the Service.
17. Termination
You can stop using the Service and cancel at any time. We may suspend or terminate your access for material breach of these terms if the breach is not cured within 14 days of notice (or immediately for security abuse or unlawful use). Sections 6, 9, 10, and 14–19 survive termination.
18. Changes to these terms
We may update these terms. For material changes we will give at least 14 days' notice by email or an in-product notice before they take effect. Continued use after the effective date means acceptance. The current version always lives at getfogproof.com/terms.
19. Governing law and disputes
These terms are governed by the laws of the State of Texas, USA, excluding its conflict of laws rules. Courts located in Texas have exclusive jurisdiction, and both parties consent to venue there. Before filing anything, contact us — most issues are fixable by email.
